1. Purpose, object and scope of application

These stipulations regulate the contracting of products and services offered and the advertising directed to its clients/users by PALA, PALETA O RAQUETA, S.L., a commercial company that operates through the internet from its website (www.justten.es) offering its customers a wide variety of products. These General Conditions also regulate the rights and obligations of the parties derived from the sale and purchase operations agreed between them.

The clauses that are listed below configure the framework contract that all users who access the website www.justten.es are obliged to know and accept. For the sole purpose of these general conditions, the expression "user" includes any Internet user who accesses the website www.justten.es, either directly or from any other website.

The services offered by PALA, PALETA O RAQUETA, S.L. on this website will be governed by the conditions contained in this contract. PALA, PALETA O RAQUETA, S.L. reserves the right to modify, in whole or in part, these general conditions, being applicable the new ones agreed upon from the moment of their publication on the website. In any case, the aforementioned modifications will not have retroactive effects on the goods or services already previously contracted by users.

These General Conditions bind both parties and form an integral and inseparable part of the sale contract whose effectiveness operates at the time of signing the order at the request of the client, through the contracting mechanisms that will be specified later, all in accordance with that provided for in art. 1255 of the Civil Code that includes the principle of the autonomy of the will and agreements between the contracting parties. For all purposes, it will be understood that the user accepts the conditions and rules of use related here if they press the "Accept" button that appears at the bottom of this document.

Likewise, in accordance with the aforementioned Royal Decree 1/2007, it offers the client both the pre-contractual information (see these General Conditions as well as the additional information in the different sections of the website) as well as the confirmation of the legally required information.

4. User/client access conditions

User registration: The client/user, prior to the formalization of the purchase of any of the products offered by PALA, PALETA O RAQUETA, S.L., must register its data and personal circumstances necessary for the formalization of the sale contract (name and surname or company name, DNI/NIF, address, email address, telephone/fax number).
The user may only contract and place orders if it is of legal age. Otherwise, the responsibility for placing orders by minors will be borne by the parents or legal guardians of the minor.

In order to place orders on the website, each client will provide PALA, PALETA O RAQUETA, S.L., voluntarily and under their responsibility, its personal data.

All personal data provided by clients fraudulently or falsely may be considered a crime of falsification of commercial documents.

PALA, PALETA O RAQUETA, S.L. may offer its customer a personal registration system through a personalized access code (login) and a keyword (password) to facilitate future purchase operations for the customer. PALA, PALETA O RAQUETA, S.L. is exempt from any responsibility derived from the incorrect use or negligence on the part of the client in complying with their obligation of confidentiality of their access codes.

5. Offer and acceptance process

PRODUCT PURCHASE AND SALE CONDITIONS

Pricing policy: PALA, PALETA O RAQUETA, S.L. reserves at all times and unilaterally the right to modify the products and services offered through its website. To guarantee the customer the certainty and security of the price of their products, this will be the one in force in the advertising coinciding with the time of formalizing the order.

In the electronic purchase process, the following steps will be followed according to the options menu consigned on the PALA, PALETA O RAQUETA, S.L. website.

Information about the product offered to the customer: Includes the characteristics of the product.

Information on the price of the product: Information on the final price or sale price to the public of the product to be purchased, containing in the same order the final cost for the customer and including VAT, shipping costs and insurance of goods and handling derived from transport. This final cost, therefore, will be communicated to the customer in the electronic purchase process before it formalizes its acceptance by choosing the option "order acceptance" from the options menu.

(Royal Decree 1496/2003 on Invoicing regulations, modified by Royal Decree 87/2005). The invoice will be issued in the name of the individual or company that places the order, so the customer must ensure that the order is placed in the correct name. Subsequent changes will not be possible.

PALA, PALETA O RAQUETA, S.L. warns that, for reasons of personal data protection, duplicate invoices will only be issued to the person holding the contract. No duplicates will be issued to third parties. PALA, PALETA O RAQUETA, S.L. will not send duplicate invoices by fax or email but only to the address designated by the contract holder. Once the guarantee period has elapsed, no more duplicate invoices may be issued.

The sale is limited to four units per product for each order.

Delivery period of the purchased product: An approximate period of 2-3 working days is established for the effective delivery of the product, counting from the moment in which the delivery date of the same was set when the order was placed in the payment orders against refund. Orders in advance payment with proof of payment within the delivery period set during the formalization of the order will have the same computation start date as that of orders for cash on delivery. For advance payment orders without proof of payment within the delivery period of the product set when placing the order, the period of ten days will begin to count from when PALA, PALETA O RAQUETA, S.L. has knowledge of its realization.

The delivery time of the merchandise depends on the location where it is to be delivered to the customer. In the event of a delay in delivery of more than 30 days on the approximate period of receipt of the product set when placing the order, and as long as this delay is attributable to PALA, PALETA O RAQUETA, S.L., the customer, after a written claim (letter, fax or e-mail), may unilaterally withdraw from the order, returning the amounts paid in the event of prepayment, in accordance with articles 103 and following of Royal Legislative Decree 1/2007.

Place and form of delivery: The order will be delivered to the address designated at the time of contracting by the client. The subsequent modification of the place of delivery requested by the client will only be possible before the order leaves our warehouses and will generate additional expenses on the sale price that will be at the expense of the buyer. The modification of the delivery address once the order has been delivered to the carrier will not be possible unless the customer bears the costs and this is expressly agreed between the parties. The merchandise will be delivered to the customer by a transport company, together with a delivery note in which the data that allows identifying the customer, the order and the number of packages that make up the shipment will be entered.

The merchandise is at all times covered by insurance against risks of transport, loss and manipulation during transport.

Important: Make sure that the package received is externally in good condition. Otherwise, write down this fact on the carrier's delivery note, reject the shipment and notify PALA, PALETA O RAQUETA, S.L. in writing, within the next 24 hours. In cases of deterioration of the product or lack of conformity due to transport (which are not manifest at the time of delivery or are not visible externally), you must notify PALA, PALETA O RAQUETA, S.L, within seven natural days after receipt via email.

Merchandise that could not be delivered within a period of seven working days from its departure from the PALA, PALETA O RAQUETA, S.L. facilities, for reasons not attributable to the seller, will be returned to the seller, restoring the amounts paid by the seller product in case of orders in the prepaid mode except for the costs of re-dispatch (return) of €4.99.

PALA, PALETA O RAQUETA, S.L. will serve its products offered on the website only to the Peninsula and the Balearic Islands. Orders outside these areas (for example the Canary Islands, Ceuta and Melilla) will be dispatched under specific delivery conditions and prices calculated at the time of purchase.

PRODUCT TEST CONDITIONS. TEST PADEL DEPOSIT.

PALA, PALETA O RAQUETA, S.L. offers all registered customers on its website (justten.es) an exclusive padel racket test service, according to the following conditions:

The client has the possibility of testing a padel model of its choice, during a period of 7 calendar days, paying the amount corresponding to the padel and acquiring the test padel in the form of a deposit for its sale price, through the website justten.es.

The customer who purchases the deposit of a test padel, has the right to carry out, at most, the test of two different padel models and during a period of 7 calendar days for each requested padel. At the end of said test, PALA, PALETA O RAQUETA will pay the full amount or will send you the chosen paddle, according to the amount deposited as a guarantee and after formalizing the acquisition for the current price at that time in the catalog (including all promotions and discounts).

The shipment and return (or exchange) of the test padels will be borne by PALA, PALETA O RAQUETA, S.L., except in the case in which the client decides NOT TO CONFIRM the purchase of any of the padels in the test period; in said case, the penalty will be equivalent to the amount of registered shipments and returns (€10.00 + VAT per shipment), plus management costs of €29 i.n.i.

At the time of making the return (or exchange) of the test padel (TEST), it must be sent with the original packaging and wrapping, to minimize the risks of damage or damage during the journey.

PALA, PALETA O RAQUETA, S.L. always recommends that the customer check the contents of the package to verify that the reference of the test padel is correct and that it is in optimal condition for conducting the test on the track.

PALA, PALETA O RAQUETA, S.L. verifies the status of all test paddles sent to its customers and will check that, at the time of its return, the test paddle/s do not present impacts or damage that would condition the use of the padel in another test/s and by other clients. In this case, PALA, PALETA O RAQUETA, S.L. reserves the right to apply a penalty of 50% of the total price of the padel.

The acquisition in the form of a test padel deposit is limited to two units for each customer order per month.

For the conditions of sale and delivery, the same conditions that apply to the usual purchase of PALA, PALETA O RAQUETA products through its web channel will be applied and governed by the following clause:

"The commitment acquired by PALA, PALETA O RAQUETA, S.L., for the sale and delivery of the merchandise offered is subject to the stock of the advertised product and its availability until stocks last, so PALA, PALETA O RAQUETA, S.L., in its commitment to quality and customer service, tries at all times to make the advertised products available. However, in the event of exceptional circumstances such as abusive ordering, interactive multi-ordering or those others that cause the end of stock of the product, the order and the contract subscribed between the parties will be without effect by virtue of this resolution clause, fully restoring to the client in case of prepayment the amounts paid by the same.”

6.  Products guarantee

The guarantee of the products sold by PALA, PALETA O RAQUETA, S.L. is provided and established by virtue of the regulations contained in current legislation, in particular, in the aforementioned Royal Legislative Decree 1/2007, article 114 and following, legal framework which purpose is to provide the consumer with different options to demand remediation when the acquired good is not in accordance with the contract, giving him the option to demand the repair or replacement of the good, unless one of these is impossible or disproportionate. When the repair or replacement is not possible or is disproportionate, the consumer may demand a price reduction or the termination of the contract.

In case of lack of conformity of the product, a period of two years is recognized from the moment of delivery so that the buyer can enforce its rights, however, only in the 6 months following delivery it will be presumed that the lack of conformity already existed at the time of delivery, corresponding to the buyer to prove, in the remaining 20 months (that is, from the seventh to the end of the two years) that the good was non-compliant, all in accordance with article 114 and following the aforementioned Royal Legislative Decree.

Guarantee and quality certificate: PALA, PALETA O RAQUETA, S.L. offers a product quality guarantee for a period of 4 months from the date of purchase; the guarantee will be valid only and exclusively presenting the purchase invoice of the product purchased together with the guarantee document stamped and completed by the merchant where it is acquired. This warranty covers only manufacturing defects. No product will be returned that has been found to have suffered damage derived from the misuse of it by the customer; PALA, PALETA O RAQUETA, S.L. exempts the validity of the warranty if it is found that the product has undergone modifications or repairs outside our company. In the case of the products in the SPECIAL OFFERS section, the official guarantee of the brand is responsible for the replacement and/or refund of the product, according to its market value at the time of purchase.

7. Claims

8. Client rights

Confidentiality and security of the client's personal data in accordance with the provisions of current Spanish legislation on data protection.

The right of withdrawal will not proceed after the indicated period, nor on products subject to fluctuations in a market not controlled by PALA, PALETA O RAQUETA, S.L., nor on perishable objects, objects that can be easily reproduced immediately or that by their nature cannot can be returned. Neither will proceed the withdrawal of goods or orders that may be considered due to their special characteristics as requested by the client.

In cases of wear or deterioration of the property for reasons that are not exclusively due to its proof to make a decision on its final acquisition, PALA, PALETA O RAQUETA, S.L. may agree with the client the corresponding compensation proportional to the deterioration.
